Student loans are hard to discharge but not impossible. As experienced bankruptcy attorneys, we have been through the steps many times before and have been able to help many individuals discharge the student loans. There is a process which must be followed and conditions which must be met, such as:
- To be eligible, you must try an administrative disposal first. This is essentially asking the lending institution to forgive the loans or work out a payment plan. They usually don't, but this is the first step.
- File for chapter 7 or chapter 13 bankruptcy.
- File an adversary proceeding. This is a process by which we tell the court that there is a very good reason why you cannot pay the student loans, so the loans should be discharged. We may show that there are hardship grounds such as illness, the loss of school accreditation, school closing or permanent disability.
- We must win the adversary proceeding in order to have the student loans discharged.
