Tampa Child Custody Attorney

Shared Parental Responsibility

For many divorcing couples, their children's welfare is their primary concern. The court also sees it that way. If a couple cannot find a way to reach a child custody agreement, the court will make a decision that is in "the best interest of the child." The court's current preference is that child custody or parental responsibility is shared.

Shared parental responsibility includes:

  • Legal decision making ability regarding education, religious upbringing and medical decisions
  • Physical responsibility for day-to-day care, food and shelter, according to an agreed to timesharing plan

At Cohen & DePaul, we will work with you to reach a shared parental responsibility agreement that works for you and your child.

Florida Visitation Attorney for Timesharing

Florida courts believe that shared parental responsibility is in the best interest of the children. It is usually best to come to an agreement outside of court and not go before a judge. Part of that shared responsibility is a timesharing agreement which will include agreements about the following items:

  • Overnight visits — how often and when will a child be at each parent's location
  • Transfer responsibility — how is the drop off and pick up handled
  • Right of first refusal — the other parent gets the first option to care for the child if the scheduled parent is unable to for some reason
  • Vacations — short school year vacations and major time during the summer
  • Holidays — national and religious holidays are typically shared equally or alternated

Modifications to Timesharing Agreements

Situations arise in which the agreement may need to be altered and a parental responsibility modification agreement can be obtained. Typically the modifications are needed because of a change in one parent's job, health status, relocation or remarriage.
