  • I’d like to modify my mortgage interest rate during bankruptcy. You can now go to mediation in your chapter 13 bankruptcy to negotiate a loan modificationfor your mortgage.  Loan modifications reduce your monthly payments by changing the terms of your loan, such as extending the term of your loan, lowering your interest rate, and in some cases reducing the principal balance on your loan. The bankruptcy loan modification program has an 80% success rate as of January 2013.  That means 4 out of 5 people going to mediation in bankruptcy are getting loan modifications. We can help guide you through the process and assist in negotiating your loan modification.
  • I am considering a chapter 13 bankruptcy but my mortgage is upside down. If you have a second mortgage on your home and your primary mortgage is less than the home’s value, you may be able to strip your second mortgage during a bankruptcy, either in a chapter 7 or chapter 13 case.  We can review your situation to let you know if you are eligible to strip the second mortgaeg on your home.
  • I’d like to keep my homestead and still file chapter 7 bankruptcy. You can do that as long as you are current on your payments when you file the case, or if you are able to get a loan modification from your mortgage lender. There are specific conditions that must be met and we can help you make a decision that is right for you.
  • My home is fully paid for, and I’d like to keep my homestead when I file chapter 7 bankruptcy. You may be able to do that, depending on how long you have owned your home. We would be happy to explain to you how it works.
