  • I am considering a chapter 13 bankruptcy but my mortgage is upside down. If you have a second mortgage on your home and your primary mortgage is less than the home’s value, you may be able to strip your second mortgage during a bankruptcy, either in a chapter 7 or chapter 13 case.  We can review your situation to let you know if you are eligible to strip the second mortgaeg on your home.
  • I’d like to keep my homestead and still file chapter 7 bankruptcy. You can do that as long as you are current on your payments when you file the case, or if you are able to get a loan modification from your mortgage lender. There are specific conditions that must be met and we can help you make a decision that is right for you.
  • My home is fully paid for, and I’d like to keep my homestead when I file chapter 7 bankruptcy. You may be able to do that, depending on how long you have owned your home. We would be happy to explain to you how it works.
