Many people are reluctant to file for bankruptcy because they fear what it will do to their credit rating and their ability to get loans or financing. Our clients have a number of common concerns:

  • Can I file for bankruptcy again in the future? Yes, but there is a time restriction. You must wait eight years before filing for a second chapter 7 bankruptcy.
  • Can I keep one of my credit cards? The credit card companies usually cancel your credit cards when you file bankruptcy. You still have the option of paying cash, using a debit card, or a pay-ahead credit card.
  • Can I get a new car loan? You can apply for a new car loan after you complete your Bankruptcy, or during a case with permission from the court. Having a car loan with timely payments can help rebuild your credit score after Bankruptcy.
  • Will I lose my home? That largely depends on your payment record and your current income status. If your payments on your home are current, you usually can keep your home.  If you are behind in your mortgage payments, we may be able to get a loan modification or strip a second mortgage in your bankruptcy case to make your mortgage payments affordable so you can keep your home.  We would be happy to answer your specific bankruptcy and mortgagequestions.

The Purpose of Bankruptcy

Bankruptcy laws were not created to embarrass you. They were created by the government to allow people to start over and move on with their lives. We can help you get there.

“If you having been paying on the same debt for four or five years, there’s a good chance you have already paid the amount you spent on the card, and are now just paying interest. Filing for bankruptcy can help you get out from under your debt and allow you to move on with your life.” — Bankruptcy lawyer Wendy DePaul
